SC orders govt to amend laws on rape

Supreme Court ordered the government to amend the provision of statute of limitations in rape cases by discussing the issue with the concerned agencies.

A division bench of Justice Gopal Parajuli and Cholendra SJB Rana issued an order to present a draft of amended law at the parliament after discussing the draft with the concerned agencies and organizations.
Advocate Raju Prasad Chapagain on behalf of Justice and Rights Institute Nepal had filed the writ petition on April 9, 2014 demanding a writ to annul and amend the provision of statute of limitations by fast-tracking the amendment process.

The petitioner had also asked for orders to amend the existing laws and make unlawful any delay in investigating and registering rape cases as well as obstructing the investigation process as punishable criminal offence. Likewise, the petitioner had asked for legal assurance for preparing national work plan to raise awareness.

The bench has ordered the government to present a draft of amendment in parliament by addressing all the issues raised in the petition.
